What are the penalties for Possession of Prescription Drugs (or a controlled substance) in Kansas City, Missouri?
Possession of a controlled substance – Anyone who is found in possession of narcotic drugs such as those mentioned above must have a valid prescription. Without a legitimate prescription, you can be charged with possession, which is considered a class C felony offense in Missouri. At a minimum you will face one year in prison if convicted; depending on whether you were found in possession of a large amount of the narcotic drug, you could face drug trafficking charges. A conviction for this offense will result in a maximum of seven years in prison depending on the circumstances of your case.
What are the penalties for Selling or Distribution of Prescription Drugs in Kansas City, Missouri?
When charged at the federal level, those found guilty of selling or distributing prescription narcotics face extremely serious consequences. For example, a conviction for selling OxyContin (oxycodone) may result in up to 20 years in prison along with significant fines of up to $250,000 or more.
Many prescription drugs are categorized by the DEA (Drug Enforcement Administration) into a schedule whereby Schedule I drugs are considered the most dangerous in terms of abuse potential, and Schedule V including those substances with the lowest potential for abuse. Oxycodone, hydrocodone, fentanyl, methadone, and other prescription drugs are considered Schedule II substances, which mean they have a high potential for abuse or addiction. Frequently someone who is prescribed one of these narcotic pain medications becomes dependent on the drug, which can result in that individual resorting to illegal means to get the narcotic when the drug is no longer prescribed.
