While all criminal charges are serious, misdemeanor crimes in Kansas City are those considered less serious than those classified as felonies. What are the factors that determine whether an offense is a misdemeanor or felony? In most cases how the crime is charged hinges on the extent of injury to another individual, how much stolen property is valued at, or even how much of an illegal drug or substance someone has in his or her possession.
At The O’Connor Law Firm, we know that misdemeanor charges are not to be taken lightly and some can have serious consequences; especially depending on any previous criminal record. Like more serious charges, a misdemeanor can leave you facing jail time, a criminal record, and more. If you have been arrested or are under investigation, contact a Kansas City criminal defense lawyer with our firm now.
Examples of Misdemeanor Crimes & Charges in Missouri
Misdemeanor crimes are charged as class A, B, or C with class A charges being the most serious. Essentially, a person convicted of a class A misdemeanor will face harsher punishment than someone found guilty of a class C misdemeanor.
Class A misdemeanor crimes include shoplifting goods valued under $500, marijuana possession (35 grams or less), false imprisonment, third-degree assault, bad checks less than $500, fraudulent use of a credit card device involving a value less than $150, and more.
Class B misdemeanor crimes include DUI or DWI first offense, first-degree criminal trespass, and other similar offenses.
Class C misdemeanor crimes include first offense driving with excessive blood alcohol content, harassment, simple assault, and alteration of ID cards among others.
Missouri Penalties for Misdemeanor Charges
Those found guilty of a misdemeanor offense will face various penalties depending on whether the crime is classified as class A, B, or C. Most class A misdemeanor convictions will result in punishment that includes a fine of up to $1,000 and/or a maximum one year jail term. Class B misdemeanors are punishable by a fine of up to $500 and/or up to six months in jail with a minimum 30 day jail sentence. Class C crimes are punishable by a fine of as much as $300 and/or a maximum of 15 days in jail.
In most cases any misdemeanor offense will not result in more than one year in jail, a $1,000 fine, or combination of both. If you have any prior convictions, your need for an attorney may be much greater to ensure you don’t get the maximum punishment.
